CONTRACT FOR THE PROVISION OF SERVICES AND PARKING

GENERAL TERMS AND CONDITIONS OF THE CONTRACT AND SERVICE

Any user who wishes to contract the service must first read and accept the General Terms and Conditions of Contract and Service detailed below..

GENERAL INFORMATION

These General Terms and Conditions of Contract and Service constitute the general regulation of the services provided by Park-King Alicante (hereinafter the “Parking”), for the activity of parking with shuttle bus transfer and parking with vehicle pick-up and/or delivery by chauffeur, establishing the legal framework that governs the contractual relationship.

PURPOSE OF THE CONTRACT

The purpose of this contract is to regulate the general conditions for the provision of services offered by the Parking through its websites (hereinafter, the “Website”), the telephone booking service, and through intermediaries such as travel agencies or other internet sites.

These services may be contracted directly by customers or through intermediaries who request the service on behalf of customers. These intermediaries (hereinafter, the “APPLICANT”) may be natural or legal persons, and may have specific conditions for contracting the service, but in all cases, such conditions shall be additional and shall in no case override or contradict any of the conditions set out herein.

IDENTIFICATION OF THE CONTRACTING PARTIES

These General Terms and Conditions of Contract and Service offered by the Parking are entered into on the one hand, by the entity Park-King Alicante with registered office in Spain.

And, on the other hand, by the client (hereinafter, the “CLIENT”), a natural or legal person who may have made the reservation through different means, and who transfers responsibility of the vehicle to the Parking at the time of accessing the parking facility or delivering the vehicle to a company chauffeur.

On the other side, there are clients who have made their reservation by telephone, through travel agencies, or other intermediaries, where the data have been entered by third parties (travel agents, Parking employees, third-party providers, etc.) and therefore may not be reliable. For this reason, at the time of signing and/or accepting the contract between the parties, i.e., between the Parking and the client, which takes place when the vehicle is picked up or received by the Parking, the client must check all the data appearing in the contract and report any errors. Once the contract has been accepted, the client will be deemed to have validated all the information, and will be solely responsible for any damage or harm caused to the Parking or third parties arising from errors in such data.

When making a reservation, the client must indicate the day and time of entry to the Parking, as well as the estimated day and time of exit. The Parking will cancel reservations when the client fails to show up at the indicated date and time of entry, allowing for a one-hour grace period. The price offered to the client is based on the information provided, and therefore any modification to such information may involve a price adjustment. The rates applicable for extra time are published on the Website and/or displayed visibly at the Parking facility.

CONDITIONS OF USE AND RESPONSIBILITIES

The client certifies that they are qualified to grant the Parking the responsibility of the vehicle for the duration of the service.
The client certifies that during the service, and while the vehicle must remain under the responsibility of the Parking, the vehicle complies with all applicable regulations under Spanish and European law, and that the vehicle is in acceptable mechanical condition for safe handling and driving. This includes, but is not limited to: mandatory insurance, valid MOT (ITV), general vehicle maintenance, condition of tires, brakes, etc. In the hypothetical case that the client’s vehicle does not comply with all or part of the aforementioned requirements, the client, prior to handing over the vehicle to the parking staff, must resolve the issue, and the parking staff must verify it.

THE PARKING’S RESPONSIBILITY

The Parking is responsible for your vehicle from the moment of its reception until the moment of its return or collection.
The client authorizes the Parking to move the vehicle within its facilities or outside of them and to carry out any actions necessary to provide these services.

RECEPTION OR COLLECTION OF CLIENTS BY THE PARKING

The Parking will not be held responsible for any delays that may affect clients due to waiting for the reception of the vehicle, the time taken to formalize the contract, the waiting time for the return of the vehicle, or shuttle transfers, if caused by local traffic, police controls, roadblocks, accidents, or other force majeure events. Except in cases of fraud or negligence.

COMMON INCIDENTS IN AIRPORT-AREA PARKING

Due to temperatures (winter -10º and summer +45º), signal jammers, electronic sweeps carried out by the airport or security forces, or aircraft security systems flying over the Parking, or electromagnetic waves emitted by Madrid Barajas Airport, the electronic systems of vehicles often fail (GPS, electronic keys, vehicle security systems, etc.). All of this forces battery consumption of parked vehicles, and it is possible that batteries may discharge, even in semi-new or new vehicles Near Parking Alicante declines any responsibility for this matter and the client accepts it. It is the exclusive responsibility of the client to maintain their vehicle and take the necessary measures to prevent such situations from affecting it. The client must resolve this situation by their own means, as the Parking lacks administrative licenses as a workshop, insurance, materials, machinery, cables, and/or qualified staff to resolve it.

Clients who leave their vehicle at the Parking are aware of common situations in airport-area parking that may affect their vehicle or its maintenance. Another common issue that may occur in long-stay parking involves tires, whether new or semi-new. Pores or small punctures that occur on the road before arriving at the Parking can cause a tire to deflate after being parked for several days. This is because tires are designed for safety reasons in such a way that they lose pressure when stopped, and not while in motion on the road. Near Parking Alicante declines any responsibility and the client accepts it. It is the exclusive responsibility of the client to maintain their vehicle, and the client must resolve this situation by their own means.

In general, the Parking does not have administrative licenses for automobile services or roadside assistance and therefore cannot carry out this business activity. It does not have insurance, tools, cables, machinery, jump starters, professionals, or licenses for such mechanical tasks to provide assistance. Therefore, the client must contact their roadside assistance service to resolve these or other situations.

KEY DEPOSIT

To provide the parking service, it is mandatory to deposit the keys at the Parking if requested by its employees. During low occupancy periods, the client may keep the keys to their vehicle, except when services requested by the client require the movement of the vehicle (chauffeur/Drivercar, washing, etc.). In particular, it is necessary and essential to deposit the keys during high season, weekends, holidays, Christmas, New Year, Easter, and from June 1 to October 30. The client accepts and forfeits their reservation if they do not wish to leave their key at the Parking. This clause is a resolutory condition of this contract.

INSURANCE

The stay of your vehicle is covered by our damage and liability insurance in accordance with Parking Custody Law 40/2002.
The Parking is not responsible for removable accessories or objects inside the vehicle if their existence has not been communicated to our staff at the time of delivery.

CONTRACT FOR THE PROVISION OF SERVICES AND PARKING

VEHICLE RECEPTION

The Parking is responsible for verifying the existence and operation of the vehicle at the time of reception, as checked by our staff and noted in the contract before it is accepted by the client.
The Parking is responsible for any damage to the client’s vehicle inside or outside the Parking facilities if it is driven by Parking staff.

Client vehicles that are parked within the Parking facilities, or driven, removed, or delivered within the Parking or to and from the airport by Parking staff, are covered by insurance of up to €20,000 per vehicle with a deductible of €150 per claim.

RETURN

Modifications of dates, times, and/or flights may result in surcharges on the final parking amount. Reservations are, in all cases, an estimate based on the dates, times, and services requested at the time of entry into the Parking.

Due to the concentration of electromagnetic waves, radio frequencies, and signal jammers in the airport area, we are not responsible for the malfunction of GPS, car keys and remotes, alarms, immobilizers, and other electronic devices in clients’ vehicles.

After the vehicle has been collected by the client, claims must be sent by email to Info@aeropuertoalicanteparking.com or by regular mail to Park-King Alicante (Customer Service Department).

ADDITIONAL SERVICES

The contracting of additional services will be carried out through the Parking’s systems and will be confirmed at the time of reception/delivery of the vehicle at the Parking or to a Parking chauffeur. In the hypothetical case that the Parking is unable to provide the service for any reason, the additional contracted service will be canceled and no cost will be charged to the client. The client accepts this situation without the right to request or deduct other amounts payable for their parking or for other services contracted and provided by the Parking.

LANGUAGE

These Terms and Conditions of Contract and Service are offered in Spanish. The Parking is not responsible for any damage or harm that may be caused to the client or third parties due to lack of understanding of the same.

VALIDITY OF THE RESERVATION PROCEDURE AS PROOF OF ACCEPTANCE

Both parties expressly declare that the making and acceptance of the reservation by the client or an intermediary through the various means, and the subsequent acceptance of the reservation by the Parking, constitutes full and express acceptance of these general conditions.

PAYMENT

The Parking will charge the client for the provision of the service according to the current rates published on the Website, which will appear once the dates, time, place, and corresponding service have been selected. Once the reservation has been made, it will be stored in the Parking’s database, with the assigned amount, and a copy will be sent to the applicant.

Payment for reservations made by clients through the Website or by telephone will be made in cash or by credit/debit card at the time of reception or return of the vehicle. There is also the option to pay for your reservation at the time of booking through the Parking’s Website. If the reservation was made through a travel agency or authorized agent, you may pay for the reservation through them. Remember that it is mandatory to present the reservation at the time of vehicle reception along with proof of payment.
Any changes to the service that may occur, such as extended stays or the contracting of other services, will be charged separately to the client at the time of return or collection of the vehicle.

CONTRACT FOR THE PROVISION OF SERVICES AND PARKING

CLIENT INCENTIVES THROUGH OPERATORS OR TRAVEL AGENCIES

Clients whose operator or travel agency grants them bonus days of stay or additional services at the Parking must make the reservation via the Website or through these agents, obtaining the final price that will be applied at each moment.

The Parking is not responsible for payments made to intermediaries, their refund or cancellation policies, and therefore declines any responsibility in this regard.

CANCELLATION AND REFUND POLICY

The client has the right to withdraw from this contract within 14 calendar days without any justification from the day the reservation was made online or by telephone.
Once the provision of the service has begun, the client may withdraw from completing the previously contracted parking stay. The client will pay for the portion of the service provided according to the general rates in effect at that time.

To exercise the right of withdrawal, you must notify us by any means (detailed below) of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail or email). You may use the withdrawal form provided at the end of this contract, although its use is not mandatory.

Consequences of Withdrawal

In the event of withdrawal, we will refund all payments received from you without undue delay and, in any case, no later than 14 calendar days from the date we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment used for the initial transaction, unless you expressly agree otherwise; in any case, you will incur no costs as a result of the refund.

The Parking reserves the right to take legal action to claim any unpaid parking invoices that clients have not settled within 15 days from the date of entry into the Parking.

APPLICABLE LAW AND COMPLAINT FORMS

These conditions are written in Spanish and are subject to current Spanish law. For any disputes arising from the use of the services offered, the parties, by accepting these Conditions, submit to the competent Courts and Tribunals.

Clients have access to complaint forms from the Madrid City Council and/or the Community of Madrid at the Parking facilities located at Torrellano Alto (Cami Del Gallinero Poligono 137, Parcela, 5, 03320 Torre del Pla, Alicante

PERSONAL DATA PROTECTION

For the purposes of Organic Law 15/99 of December 13 on the Protection of Personal Data, we inform you that the personal data you provide during your registration process, or at a later time, will be included in an automated file of personal data maintained under the responsibility of the Parking. The purpose of this file is the management of its users, the provision of the services you can access through our Website, the processing of reservations, the formalization of the contract, the obtaining of various statistics, and the conduct of market studies.
